Litgitimate Lawsuit? | |||||||
Some poor guy I know has had a hellish experience having sugery, the guy was being brought down to surgery when he noticed that his IV (which had been protruding out of his skin) came loose, freaking out the nurse assured him that everything was fixed. Well when he awoke from anesthesia he knew somthing was wrong. PAIN! Screaming the nurse actually said "aghh I'll give you some morphine that should help" (prior to this he was recieving a fentanyl pump, they should have known this would have no effect, even if the IV worked) well it didn't work at all, and she had the nerve to say "let it kick in", well, it was injected in his IV. Screaming that somthing was wrong he was put back in his room alone, with the door closed with no access givin for family. After 15 minutes of screaming a family member burst threw the door and saw the guy in shock flopping like a fish. It turned out the IV was never put back in properly and he was recieving no pain medication at all, as well as having his catheder removed,(which he was using prior to surgery, which resulted in extream pain becuase he could not urinate, due to the fentanyl). Now this guy has spoke to a bunch of lawyers and they all said that it was an uphill expensive battle, becuase there is no physical damage. Is it? Becuase no crap, this guy has cracked after that and is not the same mentally, on top the surgery was not effective. How can this be proved and not look like he's just trying to get money becuase beleive me he is messed up inside and can not work. Thanks for any help. |

he has tried but almost everyone told him that it would be very costly and it isn't likley it would go to court becuase there is no physical damage, although he has had numerous problems resulting from the surgery, pain. The guy doesn't have insurance or any money and when he's tried to see the surgeon he was told that payment was due at the visit. The guy spoke to about 6 lawyers. They all said that there wasn't much that can be done, do you think they just want money? |

Assuming that he spoke with several attorneys who handle medical malpractice cases, I would suggest that he take the advice of the attorneys he spoke with. If he has not discussed the matter with an attorney who had that type of practice, he should. Just to satisfy his own need to know. I assure you that if any of the lawyers saw a profit to be made in the case, they would have jumped on it in a heartbeat. Six attorneys turning the case down is a good suggestion that there isn't a viable case there. Not to say there may not have been some negligence. There may have been. There may have been some pain. But is there any provable permanent injury? You don't speak to that. These cases are expensive, protracted, time-consuming, and small cases are not pursued by the bar because they are unprofitable in the long run. The attorneys who handle these cases are interested in profit, for sure. All businessmen are in business for profit. If they just wanted money, they'd have said so up front. Lawyers are not shy about telling you they want money. They also are not shy about telling you they do not want to take a case they think will not make them a profit. mostly harmless |
